1. Scope and Provider

These Terms of Service govern your use of lean_art, an AI-powered creative studio for filmmakers, operated by Lucas Waclawczyk, Am Rehwinkel 2a, 14548 Schwielowsee, Germany ("we", "us", "our").

2. Eligibility

You must be at least 18 years of age to use lean_art. By creating an account, you confirm that you are 18 or older.

3. Service Description

lean_art provides AI-powered tools for generating and managing creative assets for filmmaking. The service uses artificial intelligence models and third-party services to process your requests. Output quality, availability, and capabilities may vary and are not guaranteed.

The assistant and all generation features are powered by artificial intelligence. You are interacting with an automated system rather than a human, and outputs may be inaccurate, incomplete, or unexpected.

lean_art is currently in an early prototype stage. Features may change, break, or be removed without notice.

4. Third-Party Services

lean_art relies on the following third-party services to deliver its functionality. Your use of lean_art constitutes acknowledgement that your data may be processed by these providers in accordance with their respective terms and privacy policies:

  • Anthropic (Claude) — conversational AI
  • OpenAI — language, vision, and audio processing
  • OpenRouter — AI model routing
  • Replicate — AI model hosting
  • Fal — AI model hosting
  • DeepInfra — speech synthesis
  • Google (Gemini) — media analysis
  • ElevenLabs — voice and audio generation
  • Runway — video generation
  • AssemblyAI — audio transcription
  • Clerk — authentication
  • Stripe — payment processing

Content you generate remains subject to the terms and acceptable-use policies of the providers involved in creating it. You agree to comply with the acceptable-use and prohibited-use policies of the third-party AI model providers whose services power lean_art, as those policies are amended from time to time, and you warrant that you will not use lean_art or any output for purposes those policies prohibit.

The third-party AI model providers whose services power features of lean_art are intended third-party beneficiaries of these terms with respect to the provisions governing use of their services, and may enforce those provisions directly.

Nothing in these terms creates any agency, partnership, or joint venture between you, us, or our providers, and you will not represent otherwise.

5. Credits and Billing

Generation is paid for in credits, denominated in US dollars of AI at what the model providers charge us. Each paid plan includes a monthly allowance of them. The allowance is a fresh amount each billing period and does not carry over; credits bought in addition to it do not expire, and an account may hold a limited balance of them at one time.

Credits bought in addition to a plan carry a markup, stated on the plan picker before purchase. All credit purchases are final and non-refundable. Generation run against your own provider API key is billed to you by that provider and carries no markup from us.

Changing to a higher plan takes effect immediately and starts a new billing period, invoiced in full with credit for the unused remainder of the period it replaces. Cancelling takes effect at the end of the current billing period. While an invoice is unpaid, new generation is suspended; credits already held are unaffected and become spendable again once payment is settled.

We reserve the right to adjust credit pricing and plan allocations with reasonable notice. Where a promotional rate is described as held for the life of an account, that rate is honoured for as long as the account remains on the plan it applies to.

6. User Conduct

You agree not to:

  • Use lean_art for any unlawful purpose
  • Generate content that is illegal, harmful, or violates third-party rights
  • Attempt to circumvent usage limits or security measures
  • Reverse-engineer, scrape, or programmatically access the service beyond its intended interface

You confirm that you use lean_art for legitimate creative work — filmmaking, writing, visual art, music, performance, or related disciplines.

You represent that you hold all rights, licenses, and consents necessary for any image, likeness, voice, or other material you upload, reference, or incorporate into your work, including the consent of any identifiable person it depicts.

You are responsible for compliance with the laws of your jurisdiction in distributing or publishing any content generated through lean_art. Generation through the service does not, in itself, constitute permission to publish.

We reserve the right to suspend or terminate accounts that violate these terms without refund.

7. Content Limits

We draw this line at what the law forbids, not at what a brand-safety policy would prefer. Difficult subject matter is the work: injury, violence, weapons, warfare and its iconography, peril, illness, addiction, cruelty, non-sexual nudity, and children shown in danger or distress are all lawful in narrative and visual art, and lean_art does not refuse them. Where a model provider we route to applies its own stricter filter, we turn that filter off wherever the provider permits it.

Regardless of asserted creative context, lean_art will not generate:

  • Any sexual or sexualised depiction of a minor, real or generated (§ 184b, § 184c StGB).
  • Sexually explicit material of any kind. Not because it is unlawful in itself, but because serving it in Germany requires an age-verified closed user group (§ 4 (2) JMStV) and we operate none.
  • Pornographic material depicting violence or animals (§ 184a StGB).
  • Sexual or intimate depictions of a real, identifiable person without their consent (§ 201a StGB, § 22 KunstUrhG).
  • Material that incites hatred against a group or denies or trivialises the Holocaust (§ 130 StGB), or that uses the symbols of unconstitutional organisations outside the artistic, scientific and reporting exemption (§ 86 (3) StGB).
  • Depictions of cruel or inhuman violence against people that glorify or trivialise it, or portray it in a way that violates human dignity, outside the same exemption (§ 131 StGB). Violence depicted as part of a narrative work is not this.
  • Identifiable depictions of real, named, non-public individuals without your explicit affirmation that you hold the necessary consent.

One limit is ours rather than the law's: we will not produce instructional or how-to material on methods of self-harm or suicide. Depicting these themes in narrative or visual art is permitted, and when a work involves them generated artifacts may include references to crisis resources.

The first two limits above are enforced automatically: every generation request, and every image and video produced, is screened for sexual material and for the sexual depiction of minors by a check that runs outside the assistant's conversation and cannot be argued with. A refusal from it is final for that request; it is not a filter to be reworded around, and attempting to do so is a breach of these terms. The remaining limits are terms you agree to rather than filters we run, because whether a depiction glorifies violence or falls within the artistic exemption is a judgement no classifier can make. We act on them when they are reported to us or when we otherwise become aware of them, and we may suspend or terminate an account for breaching them.

Where marking is available for the generating model, media produced through lean_art carries machine-readable Content Credentials identifying it as artificially generated, in line with Article 50 (2) of Regulation (EU) 2024/1689 (the AI Act). Coverage depends on the provider and the pipeline and is not guaranteed for every output, so treat the absence of a marking as an absence of evidence rather than as a statement that a file is not AI-generated. Where a work is evidently artistic, creative or fictional, the disclosure obligation under Article 50 (4) is limited to disclosing that generated content is present, in a way that does not interfere with the work. You remain responsible for that disclosure when you publish, and for not stripping a marking that is present.

8. Intellectual Property and Data Use

You own the outputs you create with lean_art, to the extent those outputs are capable of ownership and subject to the terms of the AI model providers involved in generating them. Because outputs are produced by artificial intelligence, they may not be eligible for copyright or other protection in every jurisdiction, and comparable outputs may be generated for other users. We make no warranty that an output is original or free of third-party rights; securing any rights needed to publish or commercially use an output is your responsibility.

Music generated through lean_art's AI providers may carry use restrictions under those providers' terms and, in particular, may not currently be licensed for synchronization into or distribution as part of film, television, radio, or games. You are responsible for staying within the licensed scope, and we make no representation that generated music may be used in such productions.

You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and analyze your content — including conversations with the AI assistant, prompts, generated outputs, and usage patterns — for the purposes of providing, operating, and improving the service. This includes analyzing interactions to identify what features work well, diagnose issues, and develop better experiences for all users.

We will not publish, sell, or publicly attribute your content to you. Your content is used solely for internal product improvement and service operation.

lean_art is an early-stage prototype. In exchange for access at a subsidized rate, you acknowledge that your usage data helps us understand how the product is used and how to improve it.

The lean_art platform, its design, code, and branding remain our intellectual property.

9. Disclaimer of Warranties

lean_art is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee the accuracy, completeness, reliability, or availability of the service or any content generated through it. AI outputs may be inaccurate, incomplete, or unsuitable for your purposes.

10. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of lean_art. Our total liability for any claim relating to the service is limited to the amount you have paid us in the twelve months preceding the claim.

To the maximum extent permitted by applicable law, you will indemnify and hold us and our third-party AI model providers harmless from any claim, liability, or expense arising out of your inputs or prompts, any output you generate, your use or distribution of that output, or your breach of these terms.

11. Changes to Terms

We may update these terms at any time. We will notify registered users of material changes via email or in-app notification. Continued use of the service after such notification constitutes acceptance of the updated terms.

12. Governing Law and Jurisdiction

These terms are governed by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction is Berlin, Germany, to the extent permitted by law.
